About
Emchi is a clothing rental business that provides access to premium garments for events. All users of our services must read, understand and agree to comply with these Terms. By using our services or placing an order, you enter into a binding agreement with Emchi.
Throughout this document, Emchi is referred to as ‘Emchi’’, “emchi’ or “Emchi Club”, “we”, “us”, or “our”. The customer or hirer is referred to as the “customer”, “client”, “user”, “you” or “hirer”.
By accessing our website, placing a rental order or attending a try on appointment, you must acknowledge and agree to be legally bound by these Terms. If you do not agree to any part of these Terms, you should stop using our services immediately.
Emchi reserves the right to update or modify these Terms at any time. Any changes will apply from the date they are posted. We encourage clients to review the Terms regularly to stay informed.
Definitions
The following definitions apply throughout these Terms:
Booking Date: The date the Client places an order for a rental.
Client: The individual entering into a rental agreement with Emchi.
Content: Photos, text or information posted by Emchi or users on our platform or social pages.
Delivery Fee: The postage charge for delivering rental items.
Garment: Any clothing or accessory rented from Emchi. Also referred to as Rental Item or Item.
Postal Item: A rental item that requires delivery. This differs from local hires which are collected directly.
Rental Fee: The amount paid to rent a Garment.
Rental Period: The period during which the Garment is hired.
Rental Return Date: The date the Garment must be returned or lodged at an Australia Post office.
Rental Start Date: The date the Rental Period begins.
Replacement Value: The estimated market value of a Garment, determined by Emchi.
Security Deposit: A refundable amount held for items until the Garment is returned in acceptable condition.
Terms: These Rental Terms and Conditions.
1. Payment
By entering into this agreement, you authorise Emchi to charge your selected payment method according to the Terms.
You agree:
- That you are authorised to use the payment method provided
- That you will not dispute payments if Emchi has delivered the agreed services
- That Emchi may charge the payment method for fees relating to damage, loss, late returns or cleaning as outlined in these Terms
If your payment is reversed or rejected, you must pay the outstanding balance within twenty four hours. Failure to do so will result in immediate cancellation. If the item has already been shipped, you remain liable for the full rental fee.
Emchi may engage debt recovery services or legal action if required. Any additional recovery costs will be added to the amount owed.
2. Refundable Security Deposit
Items rented through Emchi will require a refundable $50 security deposit. This deposit is charged at checkout using the card provided for your booking and is held for the duration of the rental.
- The refund status shows as Pending for up to 2 business days while funds are processed back to you.
- After that, it can take up to 10 business days for the refunded amount to appear on your bank or card statement, depending on their bank's processing times.
- Business days are Monday–Friday, excluding weekends and public holidays.
By placing a booking, you authorise Emchi to charge this security deposit and to retain or deduct from it in accordance with these terms.
If the garment is returned on time and in good condition, the security deposit will be refunded in full once the item has been inspected.
If the garment is returned with damage, stains or signs of wear requiring repair or specialised cleaning, Emchi reserves the right to retain part or all of the security deposit to cover associated costs.
If the garment is lost, stolen or not returned, the security deposit will be retained and you authorise Emchi to recover the full retail value of the item. This may be charged or invoiced separately using the contact details provided at checkout.
All assessments relating to damage, cleaning, repair, or replacement are determined by Emchi and are final.
3. Identification
All in-person try-on appointments require proof of identity, such as a passport or driver’s licence, which must be submitted at the time of booking.
For online bookings, Emchi may request proof of identity before confirming your rental.
If the required identification cannot be provided, we reserve the right to decline or cancel the booking.
4. Rental Period
Once a booking is made, you will receive a confirmation email.
Your rental period is inclusive. For example, a four-day rental that begins on Friday means the item arrives Friday and is posted back Monday. Both days count within the four-day total.
If your return date is on the weekend or public holiday, it is your responsibility to check the opening hours of your local post office.
All postal items are sent through Express Post. You will receive tracking details by email. It is your responsibility to monitor your tracking updates.
Delivery is not guaranteed earlier than 6 pm on your selected delivery date.
5. Client Cancellations and Refunds
Emchi provides store credit only for cancellation requests. Refunds are not offered.
Store credit is valid for six months.
Cancellation policy:
- If cancellation is requested more than fourteen days before dispatch or collection, store credit will be issued with no cancellation fee charged.
- If cancellation is requested within fourteen days of dispatch or collection, store credit will be issued minus fifty dollar cancellation fee.
If you request to exchange the garment of your booking more than fourteen days prior to dispatch or collection, no cancellation fee is charged. If the replacement item is of lower value, the difference will be issued as store credit.
6. Cancellations by Emchi
We may cancel your booking for any of the following reasons:
- The previous renter damaged the item
- The item was lost by a previous renter
- It is not possible to deliver the item on time due to postage delays or late returns
- Any reason at our discretion
In all such cases, you will receive a full refund to your original payment method.
7. Postage and Late Delivery
Emchi is not responsible for delays caused by Australia Post or any delivery provider.
To ensure your rental arrives on time, we strongly recommend placing your order at least one to two days before your event.
If your parcel is marked as delivered but cannot be found, you must contact us immediately. If Australia Post confirms delivery through their evidence system, you will be liable for replacement fees if the item cannot be recovered.
If you enter an incorrect or incomplete address, you will be liable for the replacement value if the parcel cannot be recovered.
Signature on delivery is required for high-value garments and must be complied with.
8. Incorrect or Faulty Items
If the wrong item arrives or if the correct item has an issue such as damage or stains, you must notify us within twenty-four hours of receiving the parcel.
If you fail to notify us within this timeframe, we may not accept responsibility and you may be liable for damages.
Garments may show minor signs of general wear. Refunds or credits will not be issued for insignificant imperfections.
9. Issues with Fit or Appearance
Emchi is not responsible or liable if a garment does not fit or does not suit the client.
We provide fit guidance to assist clients in making an informed decision. However, all online rentals are made at the client’s own risk. We do not offer refunds, credits or exchanges due to fit, sizing or personal preference.
By placing an online rental order, you acknowledge that variations in body shape, height and fit preference may affect how a garment appears when worn.
To reduce the risk of incorrect sizing, Emchi offers try-on appointments by bookings only. We strongly recommend attending a try-on appointment prior to renting if you are unsure about sizing or fit.
10. Return of Items
Postal returns must be made using the provided prepaid express satchel.
Items must be returned at an Australia Post counter on or before the Rental Return Date before 12pm. If the return date falls on a public holiday or Sunday, return it the next business day.
If you post using an express street post box, you will be responsible if the item is returned late or missing. You will be liable for one hundred percent of the original retail value or will be charged a fee each day that passes the agreed Rental Return Date.
Local hires must be returned to the collection address by 6pm on the Rental Return Date.
If the item is returned damp or wet and mould or damage occurs during delivery, you may be liable for one hundred percent of the original retail value.
11. Late Returns
Late fees apply if the item is returned after the Rental Return Date.
Late fees are calculated as the rental fee divided by the total number of rental days, charged per late day, up to one hundred percent of the retail value of the Garment.
Example: If a dress is rented for 4 days at $80, the daily late fee is $20 ($80 ÷ 4). If the dress is returned 2 days late, the late fee is $40.
12. Cleaning
Dry cleaning is included.
Do not attempt to clean the item yourself. If self cleaning causes damage, you may be charged up to one hundred percent of the original retail value.
Garments may arrive with creasing as a result of packaging and transit. Any steaming, ironing or heat application is undertaken at the client’s own risk. Emchi accepts no liability for damage caused by heat, steam, water or improper garment handling. Any damage resulting from steaming or pressing will be treated as damage under these Terms and may incur repair or replacement fees.
13. Damage or Loss
If an item is damaged, stained, torn or altered, Emchi will assess the cost of repair.
- If the damage is repairable, a repair fee will be charged based on the extent of the damage. All damages must be reported within twenty-four hours of receiving the garment.
- If the item is damaged beyond repair or lost, you will be charged the full replacement value.
- This fee will be charged automatically to the card used for your rental.
Do not cut, alter, pin, tape or modify the garment. You will be charged the replacement value if alterations cause damage.
If an item is lost by Australia Post and you can provide proof that it was lodged correctly, you will not be held liable.
14. Fake Tan Policy
Use of tanning products is at your own risk. Permanent staining will be treated as damage and you can be charged up to one hundred percent of the original retail.
15. Try-On Appointments
Try-on appointments are thirty to forty-five minutes and require a $30 non-refundable try-on fee. If you proceed with a rental, this fee may be redeemed as a credit towards your rental total. The credit will be available in your account at the time of your appointment and is valid for six (6) months from the appointment date.
This credit can be accessed online by logging into the Emchi account created using the same email provided for your try-on appointment at www.emchi.com.au.
Each appointment may be rescheduled once. If you reschedule within forty-eight hours of the appointment or attempt to reschedule more than once, the try-on fee will be forfeited.
16. International Travel
Garments may be worn overseas only with written approval from Emchi. All loss or damage overseas remains the responsibility of the client.
17. Social Media & Content Usage
By tagging @emchiclub on social media or sending Emchi a photo or video of yourself wearing an Emchi garment, you grant Emchi permission to repost, share and use this content across our social media platforms, website and marketing materials. This includes use for promotional and advertising purposes.
18. Promotions and Discount Codes
The following terms apply to any promotions or discount codes:
- Customers receive 10% off their rental after tagging us in a post or sending Emchi a photo or video.
- Cannot be used in conjunction with other promotions or discount codes.
- Discount applies to rental fees only and excludes delivery, deposits and additional charges.
19. The Polished Artist Collaboration
Emchi has partnered with The Polished Artist (@thepolishedartist on Instagram) to offer exclusive discounts for clients of both businesses.
- Any Emchi client who has completed at least one rental is entitled to 15% off their first manicure appointment with The Polished Artist. Eligible clients will be provided with a promotional code to redeem at the time of booking with The Polished Artist.
- Any existing client of The Polished Artist is entitled to 15% off their first rental with Emchi. Eligible clients will be provided with a promotional code to redeem at checkout.
The following terms apply:
- Each discount is a one-time offer and applies to a client's first booking with the respective business only.
- The discount applies to the rental or manicure appointment fee only and excludes delivery, security deposits and any additional charges.
- Cannot be used in conjunction with any other promotion or discount code.
- Emchi and The Polished Artist reserve the right to verify eligibility before honouring any discount.
- This promotion may be withdrawn or modified at any time by either party without prior notice, at which point any associated promotional codes will become invalid.
